Strict Liability

What is Strict Liability? 

As a result of strict liability law, even if a defendant did not cause an injury, he or she can still be held liable. California law recognizes strict liability when the defendant manufactures, distributes, or sells a defective product that causes injury to the plaintiff, and when the defendant's domestic animal is known to exhibit dangerous behavior. To win at trial or get a favorable settlement, the plaintiff must still prove that the defendant was legally responsible for the injury. In a product liability case, a defect must be established when the defendant's product leaves their possession. In the event of a dog bite or other animal injury, it can be difficult to prove the animal was not provoked.
